Rules for buying – selling goods

1. General provisions
1.1. These rules of the https://en.nanogo.lt e-shop (hereinafter referred to as "the Rules") are a legally binding document for the Buyer and the Seller (hereinafter referred to as the Seller) which establishes the rights and obligations of the Parties.
1.2. The Seller reserves the right to change, amend or supplement these Rules at any time. The Buyer is informed about changes in the Rules on the website of the online store.

2. Conclusion of a sales contract
2.1. A sales contract between the Buyer and the Seller is deemed to have been concluded when the Buyer forms and places the order of the goods in the electronic store after being familiar with these rules.

3. Seller's rights
3.1. In the event of important circumstances, the Seller may temporarily or completely suspend the activities of the online store without prior notification to the Buyer.
3.2. If the Buyer attempts to impair the operation, stability and security of the e-shop or violates his obligations, the Seller shall have the right to restrict or suspend access to the e-shop without notice.

4. Seller's obligations
4.1. The Seller undertakes to make available the services of the online store, the operating conditions of which are determined by this Rules.
4.2. The Seller undertakes to deliver the goods purchased by the Buyer by the delivery method chosen by the Buyer, in accordance with the conditions laid down by these Rules of Purchase and Sale.
4.3. When, due to unforeseen circumstances, the Seller is unable to deliver goods ordered in the online store, the Seller shall have the right to terminate the Sales Contract after informing the buyer. The seller can offer an analogous item. If the Buyer refuses, the Seller undertakes to return the money paid within 3 working days.
4.4.  If the Buyer has exercised the right provided for in Item 5.2 of the Rules, the Seller undertakes to return the money paid to the Buyer within 5 (five) working days from the date of receipt of the returned item.
4.5. The Seller may not reimburse the Buyer the amount of money he has paid until the goods have been returned to the Seller or until the Buyer provides proof that the goods have been shipped to the Seller, whichever occurs first.

5. Buyer's rights
5.1. The Buyer has the right to purchase goods in the online store in accordance with these Rules.
5.2. The Buyer has the right to withdraw from the contract of sale of goods concluded in the online store by notifying the Seller in writing no later than 14 (fourteen) calendar days from the date of delivery of the goods.5.3. The Buyer's right as discussed in Item 5.2 may be exercised by the Buyer only if the product has not been damaged or has not changed its appearance substantially, as well as if it has not been used.

6. Buyer's obligations
6.1. The Buyer must pay for the purchased goods and accept them in accordance with the procedure provided for in these Rules.
6.2. If the Buyer refuses to accept the goods at the time of delivery of the goods, at the seller's request, the Buyer must bear the cost of returning the goods.
6.3. At the time of delivery of the goods to the Buyer, the Buyer must verify the condition of the shipment and the goods with the Seller or the person who delivered the shipment with the person who delivered the consignment.
6.4. The buyer, using the e-shop, confirms that he agrees with these rules of purchase and sale and must comply with them.

7. Prices of goods
7.1. The prices of goods in the e-shop are indicated in euro. Prices are reported in case of VAT. When an order is confirmed, the delivery fee, if any, contributes to the total amount of the goods.

8. Ordering and payment of goods
8.1. The buyer, visiting the online store, chooses the goods he likes, which he puts in the shopping cart. After completing the shopping cart, the Buyer enters the personal data necessary to complete the order: his name, address to which the goods will be delivered, telephone number and additional information that may be relevant for the delivery of the ordered goods. The buyer confirms that he has reads these rules and confirms the order.
8.2. Payment can be made using  Šiauliai Bank,  Swed, Seb, Luminor banking electronic banking services and Visa/MasterCard payment cards. Settlements are possible in euro currency. Payments are processed using  MakeCommerce.lt  ,  Paysera.lt,  Paypal.com  payment  platforms,according to the buyer's choice.

9. Delivery of goods
9.1. When ordering goods, the Buyer must indicate the exact address of delivery of the goods.
9.2. The goods are delivered to Omniva, LP express parcel mashines or via Omniva, LT express courier according to the buyer's choice at the time of purchase of the goods.
9.3. The buyer must accept the goods himself. If the Buyer is unable to accept the goods himself, but the goods are delivered to the address indicated by the Buyer, the Buyer shall not be entitled to make claims on the delivered goods to the wrong person.
9.4. The Seller delivers the goods to the Buyer in accordance with the terms specified in the descriptions of the goods.
9.5. The characteristics of all items sold are indicated in the description next to each item. The Seller is not responsible for the fact that the color, shape or other parameters of the goods in the online store may not correspond to the actual size, shape and color of the goods due to the characteristics of the monitor used by the Buyer.
9.6. When the Buyer withdraws from the purchase-sale agreement, the Buyer shall be refunded all the amounts paid by him, including the cost of delivery of the item paid by the Buyer.

10. Return of goods
10.1. Quality goods may be returned within 14 days from the date of their receipt. Defects of defective goods sold are eliminated, defective goods are replaced and returned in accordance with the provisions of the Civil Code of the Republic of Lithuania.
10.2. The following conditions must be met when returning the goods:
10.2.1. The returned item must be in the original orderly packaging (this item does not apply in the case of the return of the defective item);
10.2.2. The item must be intact by the Buyer;
10.2.3. The product must not be used without losing its commercial appearance: intact labels, unpeakered protective films, etc. (this item does not apply in the case of the return of a defective product);
10.2.4. The returned item must be in the same set as the Buyer's received (this item does not apply in the case of the return of the defective item);
10.2.5. The seller has the right to refuse to accept the goods returned by the Buyer if the conditions for returning the goods have not been fulfilled;
10.2.6. The return of the goods shall be carried out in a manner determined by the Seller within 14 (fourteen) days from the date of receipt of the goods (this item does not apply in the event of defective goods, in which case the return of the goods within the statutory warranty period is carried out);
10.3. The return and replacement of goods of an appropriate quality shall be carried out in accordance with Article 6.22810(1) of the Civil Code;
10.4. The money paid for the goods accepted by the Buyer but subsequently refused shall be returned to the Buyer's account no later than 5 (five) days after the date of return of the goods to the Seller, unless the Seller and the Buyer agree otherwise.

11. Final provisions
11.1. These Rules are drawn up in accordance with legal acts of the Republic of Lithuania.
11.2. These Rules and relations between the Parties shall be subject to these Rules and shall be interpreted in accordance with the laws of the Republic of Lithuania.
11.3. All disagreements arising from the implementation of these Rules shall be settled by negotiation. In the event of failure to reach an agreement, disputes shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
11.4. The Parties shall be exempted from compliance with their obligations under these Rules if they cannot be fulfilled due to unforeseen circumstances beyond the control of the Parties (Force major).
